Business Credit Trends - A View From The Equifax Commercial Credit Database, Ted LaBadie, Equifax

Grab your crystal ball and join Ted LaBadie, AVP of Equifax Commercial Solutions, for a view into the state of business credit and current trends relating to business payment delinquency, business failure and business bankruptcy, including segmentation views by geography and select industries.    Gain an understanding of what is likely to happen in the future based on delinquency and failure scoring models derived from a database containing over 24 million businesses, including business banking financial obligations and trade credit obligations.

Hot and Emerging Legal Credit Issues, Bruce Nathan

This session discusses the “Red Flags” Rules that the FTC will start to enforce on June 1, 2010 and, when enforceable, will require most creditors to adopt a written program to identify, detect and respond to the risk of identity theft concerning existing and new covered accounts. The program also discusses whether the “Red Flags” Rules apply to your company and how to comply. Hot bankruptcy issues that face credit providers are also considered, including the litigation and court decisions that affect the collectability of trade creditors’ Section 503(b)(9) administrative priority claims for goods received by the debtor within 20 days of bankruptcy and how trade creditors should be dealing with such claims; the continued trend toward critical/essential vendor orders and how trade creditors can qualify as critical vendors and the critical provisions of any critical vendor arrangement and what trade creditors should be on the lookout to avoid; current issues being litigated in connection with preference claims and defenses; trade creditor rights under supply and service agreements and other executory contracts, and the trend toward faster Chapter 11s with the increase in prepackaged and pre-negotiated Chapter 11s and Section 363 sales and its impact on trade creditors.

In this session Dina will explore many ways to use the internet intelligently to save you time and increase productivity. We will review websites that offer great credit information, networking, and productivity tools. We’ll tour technologies that are hot now, and those to watch for in the future. Dina will point out the black holes lurking out there to such you in and waste your valuable work time. Finally we will review internet terminology and find out what it really means for the business user. Be prepared with your Internet war stories and triumphs. This interactive presentation will have you approaching your computer in a whole new way.

Implementing A UCC Program: Overcoming Obstacles, Jerry Bailey, NCS

Are you incorporating UCC filings into your business practices? Afraid of your customers’ reaction? One of the most important steps you can take to minimize risk and increase potential for recoveries is to execute a security agreement and to perfect that agreement through the filing of a UCC-1. Establishing certain credit policies can even help increase sales.

In this benchmarking session Gyan will cover department performance measurements including: what you should be looking at on an individual staff basis, and developing baseline figures for tracking goals (ie: number of credit applications processed; number of checks processed by each cash applicator; number of accounts unsuccessfully collected). Mr. Maharaj will be presenting and review a collection efficiency index. Also covered in this program will be deduction issues and possible resolutions for handling.

Preferences and Reclamation Rights in Bankruptcy, Shawn Christianson, Esq.

The Bankruptcy Code was revised in 2005 and made changes to both the preference section of the Code and to reclamation. This session will deal with changes in preferences and reclamation and related court decisions. It will further provide an update on the case law as it has developed around the country since 2005 in both areas, as they are of vital importance to all unsecured creditors. Major differences in preference defenses and how the courts interpret them around the country are also reviewed. Where you are sued does make a difference. The session will help you evaluate your risk before you call an attorney.
